Terms of Service

1. Acceptance of Terms

By accessing or using LobsterCage ("the Service"), operated by Aptheon, LLC ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

LobsterCage provides isolated containerized environments ("cages") for running AI agents and automated workloads. Cages can be started, stopped, and hibernated on demand. The Service includes API access, a web dashboard, CLI tooling, webhook integrations, and tunnel connectivity.

3. Accounts & Access

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials and API keys. You are responsible for all activity under your account, including actions taken by AI agents running in your cages.

4. Billing & Credits

• Credits are consumed while a cage is running. Hibernated cages consume zero credits.
• Monthly plan credits reset each billing cycle and do not roll over.
• Purchased credit packs do not expire.
• When credits reach zero, running cages are stopped and new starts are blocked.
• Subscription charges are non-refundable except as required by law.

5. Acceptable Use

Your use of the Service is subject to our Acceptable Use Policy. We may suspend or terminate accounts that violate these policies.

6. Your Content & Data

You retain ownership of all code, data, and content you place in your cages. We do not claim any intellectual property rights over your content. You grant us a limited license to host and transmit your content solely to provide the Service.

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may perform maintenance that temporarily affects availability. We will provide reasonable notice for planned maintenance when possible.

8. Warranty Disclaimer

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

9. Limitation of Liability

To the maximum extent permitted by law, Aptheon, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or profits, arising from your use of the Service. Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amounts you paid to us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Aptheon, LLC and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) actions taken by AI agents or automated processes running in your cages; (c) your violation of these terms or the Acceptable Use Policy; or (d) your violation of any third-party rights.

11. Termination

Either party may terminate this agreement at any time. Upon termination, your cages will be stopped and your data will be deleted after a 30-day grace period. We may immediately terminate or suspend access for violations of these terms or the Acceptable Use Policy.

12. Governing Law & Dispute Resolution

These terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising from or relating to these terms or the Service shall be resolved exclusively in the state or federal courts located in Delaware. You consent to the personal jurisdiction of such courts.

13. Changes to Terms

We may update these terms from time to time. Material changes will be communicated via email or dashboard notification at least 30 days before taking effect. Continued use of the Service after changes constitutes acceptance.
